Seagull Institute Terms and Conditions
The term “Seagull Institute” represents the organizers of the programs and/or the Seagull Institute affiliated companies and Seagull Transformation, Inc. that participate in the promotion and production of these programs.
How to Enroll
Please complete the online registration form on our website www.seagullinstitute.com. Upon your registration, a confirmation of your acceptance and an invoice detailing your payment will be sent to you by email. If your registration is denied, all of these fees will be returned to you.
What is included or not included in the program price?
Please refer to the detailed brochure of the program you would like to register to. If you have any questions please do not hesitate to email us at [email protected].
Methods of Payment
The program can be paid for on our website through our online registration form.
Accommodation
Accommodation is included in the program price as specified in the program brochure.
Arrival and Airport Transfers
The transfers from and to the Airport are arranged based on the program chosen. Please refer to the program brochure for more information. Email us at [email protected] if you have any questions.
Age
Seagull Institute is open to everyone aged 18 years and over.
Minimum number of participants
Each program requires a minimum number of participants; if that number is not reached the program will be cancelled or rescheduled or merged with other programs. You will be notified in case we need to cancel, reschedule or merge the program. Please do not purchase your flight ticket before receiving confirmation that the program will take place (once we reach the minimum number of participants).
Communications
Seagull Institute makes every effort to ensure the accuracy of its publications, but is not responsible for typographical or printing errors, including, but not limited to pricing information.
Photography and film material
By accepting Seagull Institute terms and conditions, you grant full permission to any and all Program Organizers to store, use, reproduce and/or resell your image or likeness by any audio and/or visual recording technique (including electronic/digital) now in existence or hereafter invented, for any legitimate purpose, including commercial sales and marketing purposes. You understand and agree that information about you that is collected by the Program Organizers, including without limitation information in the registration process and your Program experience may be disclosed to third parties for any legitimate purpose, including research, commercial sales, and marketing purposes.
Cancellations and Refund Policy
Seagull Institute has a non-refundable policy. This policy also applies in the event that the World Health Organization (WHO), or an international governmental health authority issues a country specific travel warning or forbids travel.
Travel and Medical Insurance Coverage
All participants are required to have medical and accident insurance coverage. Seagull Institute has negotiated with a travel insurance group policy with the insurance provider AVA. AVA covers hospital fees for up to 500 000 Euros, reimbursement of medical expenses for external consultations, repatriation assistance, legal and administrative assistance, general liability insurance and interrupted trip insurance. More information at www.ava.fr. By agreeing to these terms and conditions you authorize Seagull Institute to take appropriate action in the event of a medical emergency.
Late Arrivals and Absences
No refund will be granted for late arrivals to a program or absences during a program.
Liability
The Participant understands that there are dangers, hazards, and risks inherent in international travel, living in a foreign country, and the activities included in the Program including but not limited to air, land and sea travel, dietary differences, differences in legal expectations and protection, building code and other safety differences, any of which could result in serious or even fatal injuries and property damage. The Participant agrees to assume all the risks and responsibilities surrounding the participant’s participation in the Program, and understands and agrees that Seagull Institute does not assume responsibility for any such personal injuries or property damage.
In consideration of your participation in the Program, you, for yourself, your heirs, executors, administrators, personal representatives, successors and assigns (a) waive and release any and all rights, claims and causes of action you have or may have against any Program Organizer (as defined below) that may arise as a result of your participation in the Program; and (b) agree to indemnify, defend, and hold harmless all Program Organizers from and against any and all injuries, losses, causes of action, liabilities, damages, expenses (including attorney's fees and court costs) or claims (collectively, "Claims") that might arise directly or indirectly from your participation in the Program and/or the condition of the property, facilities or equipment used for the Program, regardless of when such Claim may arise including, without limitation, Claims relating to (i) theft, loss or disappearance of property, (ii) bodily injury (including fatality), and (iii) property damage, for all claims and losses (including attorney's fees and court costs), which may be brought against any one or more of them by anyone claiming to have been injured or otherwise to have suffered loss or damage as a result of your participation in the Program. For these purposes, a "Program Organizer" is any one or more of the following: Seagull Transformation, Inc. , Seagull Institute and their subsidiaries, contractors and affiliates; all organizations helping with the organization of the program; all governmental agencies representing the territory in which the Program will be held and from which resources are provided; all sponsors, agents, vendors, contractors and volunteers of or for the Program; and the licensees, officers, directors, employees, representatives, successors and assigns of each of the foregoing.
Seagull Institute will not be liable in any way to the participant in the event of any service, contracted to be supplied by Seagull Institute, becoming impossible to supply by reason of industrial dispute or other cause including but not limited to, acts of God, force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal, terrorist or threatened terrorist activities of any kind, overbooking or downgrading or accommodations, structural or other defective conditions in lodging facilities (or in any heating, plumbing, electrical or structural problem therein), dangers associated with animals, sanitation problems, food poisoning, epidemics or the threat thereof, disease, lack of access to or quality of medical care, difficulty in evacuation in case of a medical or other emergency, or for any other cause. The participant assumes all such risk as well as any risks with regard to independently engaged activities. Seagull Institute reserves the right to change or cancel the program or any aspect of the program at any time.
Participants conduct
It is understood that the international implications of this agreement are such that the conduct of participants during the course of the program is of utmost importance. Participants, therefore, agree to conform to standards of conduct consistent with the maintenance of a positive reputation of Seagull Institute and to conform to all applicable rules, regulations and policies. The Participant understands and agrees that in the event the Program Officials shall determine the conduct or academic standards of Participants are detrimental to the best interests of the program, Program Officials may terminate the participation of Participants in the program. You acknowledge and agree to abide by any Official Rules and Guidelines for the Program that may be posted at the Program or on the Program's website or otherwise communicated to you verbally or in writing at the Program and/or by Program officials. Seagull Institute reserves the right to decline acceptance or retain any participant on the program if that person’s presence is felt by Seagull Institute to be detrimental to the enjoyment of the program by others, is dangerous to the participant or others, or for failure to abide by Seagull Institute’s rules and regulations. Participants who have been removed from their program waive the right to a refund of any part of the fee. Seagull Institute may send the participant home at the participant’s own expense.
Governing Law
Any claim relating to Seagull Institute (DBA), Seagull Transformation, Inc.'s shall be governed by the laws of the State of Illinois without regard to its conflict of law provisions.
Waiver
By signing below I acknowledge my understanding of the enclosed document and participation in the Seagull Institute Program and/or any pre or post activities (the program and pre/post activities are individually and collectively referred to as the "Program"). I hereby represent and warrant that I am 18 years of age or older. By indicating your acceptance of this agreement, terms & conditions and waiver, you are affirming that you have read and understand this agreement, terms & conditions and waiver and fully understand its terms. You understand that you are giving up substantial rights, including the right to sue. You acknowledge that you are signing this agreement, terms & conditions and waiver freely and voluntarily, and intend by your acceptance to be a complete and unconditional release of all liability to the greatest extent allowed by law.
